Overview

A Junior ADU is a residential dwelling unit that provides independent living facilities for one or more persons and the unit is fully contained within the existing living space of the primary structure. It shall include permanent provisions for living, sleeping, eating, cooking and may have its own sanitation or shared sanitation with the main house. It must have its own separate entrance.

Maximum Size Up to maximum of 500 sq ft by State law and must be within the footprint of the existing dwelling.
Lot Size No minimum lot size requirements for an existing legal lot. Any newly created lot must comply with local zoning regulations.
Kitchen Efficiency kitchen with no gas (natural or propane) appliances
Bathroom Toilet, Shower, Sink
Occupancy Owner must occupy for permitting into perpetuity. A deed restriction will be recorded on title.
Development and Impact Fees Junior ADUs (due to being less than 750 sq ft) are not subject to impact fees by law.
Homeowners Associations An HOA must allow construction on separate interest properties. HOAs cannot restrict homeowner from renting out ADU as long as the term is for 30 days or more.
Ingress/Egress Must have separate entrance. You may add up to 150 sq ft to the maximum size limit if it is used exclusively for the purpose of adding ingress/egress.
